The Climb Ahead: A Comprehensive Guide to the Stages of Divorce in the UK

Embarking on the path of divorce can feel like preparing for a gruelling mountain climb.

When I started on my divorce journey, to be honest I did not really know what to expect!

Yes! I read about what I had to do but there was not a comprehensive guide as to what to do and when to do it. That is why I created this blog post and the free checklist at the end. ALso true to my passion for hiking, I’ve likened the process of divorce to a hike.

The process is often long, winding, and filled with obstacles. However, understanding the path ahead can provide the map and compass you need to navigate through these challenges. This guide will provide you with an overview of the stages involved in a divorce in the UK. Remember, while this synopsis will provide you with a general understanding, it is essential to seek professional advice to apply to your specific circumstances.

Stage 1: Preparing to Ascend – Initial Considerations

Before you begin your journey, you need the right equipment and preparation – consider this the first leg of your climb.

Seeking Legal Advice: Like a seasoned mountaineer, a solicitor can guide you through the tricky terrains related to the divorce process. The Solicitors Regulation Authority advocates the importance of professional counselling in navigating the legal maze of divorce.

Grounds for Divorce: For a divorce in the UK, you need to present proof of an irretrievable breakdown in the marriage. Documenting this breakdown, whether due to infidelity, abandonment, unreasonable behaviour, or separation is important UK Law.

Alternative Dispute Resolution: Before setting off on a contentious route, consider mediation or alternative dispute resolution tactics National Family Mediation. These methods offer ways to resolve issues outside of court, thus reducing emotional strain and costs.

Stage 2: The Ascent Begins – Filing for Divorce

Embarking on the path of divorce can feel like preparing for a gruelling mountain climb.

Stage 3: The Path Gets Steeper – Financial Settlement

This stage is often a steep ascent with lots of intricate negotiation around financial matters.

Financial Disclosure: You and your spouse need to provide full disclosure about your respective financial situations. This includes assets, income, pensions, and future needs (GOV.UK).

Financial Settlement: An amicable agreement is ideal, but if that’s not possible, the court may intervene to help reach a financial settlement. The court considers many factors, including income, earning capacity, property, and other financial resources.

Stage 4: Carrying the Load – Child Custody and Support

If children are involved, the climb takes another challenging turn. Every decision must put their best interests at heart.

Child Custody: The welfare of the child is of utmost importance (Children Act 1989). Both parents should make collaborative decisions about who the child will live with and how the child will maintain a relationship with both parents.

Child Support: Calculating child maintenance can be a complex task. The Child Maintenance Service provides resources and tools to understand this process better.

Court Involvement: In cases where parents cannot agree, it may lead to further court involvement.

Stage 5: The Summit in Sight – Decree Nisi and Decree Absolute

When you reach the peak of your journey, you encounter the stage of obtaining Decree Nisi and Decree Absolute.

Decree Nisi: This provisional decree is a signal that the court does not see any reason why the divorce cannot be granted. But it isn’t final just yet.

Decree Absolute: This marks the end of your uphill battle—the point where the marriage legally dissolves (GOV.UK).
